Man Bags 14 Years Imprisonment For Sexual Assault
An Ikeja Special offences and Domestic Violence Court has sentenced one Ezeh Peter to 14 years imprisonment for attempt to commit sexual assault by penetration. Peter happens to be the boyfriend to the elder sister of the survivor.
Justice Rahman Oshodi held that the prosecution has proved the ingredients of attempt to commit sexual assault by penetration against the convict beyond reasonable doubt.
The convict was initially charged with one count of defilement of a 16-year-old on April 12, 2022, and was arraigned on June 2, 2022.
He pleaded not guilty.
During the court proceedings, the Judge told the court that when the case was on February 26, 2025, the prosecution counsel B.E Okeowo, with the consent of the defense counsel G.E Titus, informed the court of a plea and sentence agreement.
He was rearrained on an amended information darted and filed on February 26, 2025, on one count of an attempt to commit sexual by penetration.
The defendant pleaded guilty.
Justice Rahman Oshodi found the defendant guilty of the offense of attempt to commit sexual assault by penetration under section 262 of the criminal law of Lagos state.
“Ezeh Peter, having found you guilty of the offence charged which you have been convicted is a serious one involving a sexual violation of a minor.
“What makes your case particularly disturbing is the victim was the younger sister to your girlfriend, a 16 year old child who was brought to your house. You bridge the trust and a sue her twice.
“I sentenced you to 14 years imprisonment which shall commence from the day of your remand, September 29, 2021 and your name should be registered as a sex offender. “ He said
Earlier, during the case proceedings, Justice Rahman Oshodi Tom informed the court that the prosecution counsel, B.E Okeowo, had called three witnesses regarding the case. PW1 the survivor, PW2 the survivor sister and PW3 IPO
He said that the survivor, during the examination in chief on September 10, 2025, detailed how she accompanied her elder sister to the defendant’s house. She detailed two separate instances of defilement.
“As I was already asleep, then I saw a shadow on me, the defendant shadow. Before I could scream he covered my mouth and grab gown and raped me. Few minutes later my sister came in, I was already asleep and waited for both of them to sleep, so I stood and went to the bathroom to clean myself up because there was blood in my cloth coming out of my vagina.”
She further told the court about the second incident the following day.
“He said there was no network but there is network on the bed, the defendant told me to seat down on the bed and I sat down there. I was an inche far from him a she raped me the second time.”
She also told the court that the defendant gave her a crusher Postinor 2 after the incident.
PW2 the survivors elder sister testified in examination in chief that she was in a relationship with the defendant and corroborated her younger sisters account about visiting the defendant house on September 10, 2021 and living her sister alone while she went to charge her phone.
She further told the court that the following day while returning, she found her sister crying who then reveal the defilement to her.
“When I got back home, I met my sister crying and I asked her what the problem was, she told me that the defendant raped her that was her she confessed what happened the night before.
“When she told me everything, I was hurt. I was not myself at all hearing that. The defendant wasn’t at home and when he came back I confronted him immediately. He denied it but I saw prove in my sisters body. I saw sperm and after the whole argument he said he was just playing with her”
PW3, the IPO testified in examination in chief tendered medical evidence and conducted an investigation including visiting the crime scene and arresting the defendant. The IPO told the court that the defendant denied the allegation but later admitted giving the survivor postinor 2.
